Welcome to Wellevate. These Terms of Service ("Terms") are a legal agreement between you and Wellevate ("Wellevate," "we," "us," or "our") and govern your use of the Wellevate iOS app, Android app, and the websites at wellevateapp.com and app.wellevateapp.com (together, the "Service").
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Your privacy is covered separately in our Privacy Policy.
Use Wellevate for your own personal wellbeing. Be kind and lawful. Understand that the app supports growth and is not medical care. Sol is a support buddy, not a therapist. Premium features are sold as auto-renewing subscriptions or a one-time lifetime purchase through the App Store or Google Play. You can cancel a subscription any time in your store account settings. Deleting the app does not cancel a subscription.
You must be at least 13 years old, or the minimum age of digital consent where you live, to use the Service. If you are under the age of majority where you live, you need a parent or guardian's permission. By using the Service you represent that you meet these requirements. Sol is meant for people who can use a wellness app on their own.
You can use much of Wellevate as a guest. A guest still has a private identity on our systems so your practice can persist on that device. If you create an account (email, Apple, or Google), you are responsible for keeping that login secure and for activity under it. Please give us accurate information and write to [email protected] if you suspect someone else is using it.
If you later save a guest practice to an account, we attach what you built to that account so it can follow you. Do not share your login. Accounts are personal and not for resale.
Wellevate offers self-guided wellness tools: mood check-ins, journaling, rituals, intentions, breathwork, sound, mantras, and Sol, an AI support buddy. It is for general wellbeing and personal growth only.
It is not a medical device. It does not provide medical advice, diagnosis, treatment, or therapy. Sol generates supportive, general replies and is not a licensed professional. Always seek a qualified health provider for medical or mental-health concerns.
If you are in crisis or may harm yourself or others, contact your local emergency number or a crisis line immediately. In the United States you can call or text 988. Never disregard professional advice or delay seeking it because of something in the app. Settings also includes Help and Resources.
Sol reads what you write and replies in a warm, plain voice. It may remember details you have already shared so a new chat does not start from zero. It may mention a journal, check-in, or ritual when that genuinely fits, and only as an offer.
Sol is powered by OpenAI, LLC, a third-party AI service. Before the first message we ask your permission in the app. If you continue, we send OpenAI (through our proxy) the text you typed, a short memory summary, and compact notes you already saved. If you tap Not now, nothing is sent. See the Privacy Policy.
Sol can be wrong, incomplete, or a poor fit for the moment. Do not rely on it for emergencies, medication, or clinical decisions. We may limit or suspend Sol if it is abused or if we need to protect the Service.
Wellevate Premium is optional. Current plans, shown in the app and on the stores, typically include:
Prices are shown in the app before you buy and may vary by region. Taxes may apply. We will not change the price of an active subscription term without notice.
For purchases through the Apple App Store or Google Play:
Lifetime access is personal to you. It lasts for the remaining life of Wellevate Premium, which may not be the rest of your life. Features can evolve. A lifetime purchase does not include every future product we might launch outside Premium, and it cannot be transferred, licensed, or sold.
Refunds are handled by the store that took the payment, under that store's policies. We generally cannot issue those refunds ourselves. For App Store purchases use Apple's Report a Problem page. For Google Play, use Google's refund process.
Purchases through the App Store are also subject to Apple's standard Licensed Application End User License Agreement (EULA).
Please do not misuse the Service. You agree not to use it for anything unlawful or harmful; try to reverse-engineer, disrupt, or gain unauthorized access; upload content that infringes others' rights or that is abusive; or use automated means in a way that burdens our systems. Do not use Sol to seek or provide medical, legal, or other professional advice it is not built to give.
The journals, moods, rituals, chats, and other content you create are yours. You grant us a limited license to store and process that content solely to operate the Service for you (for example, saving an entry and letting Sol answer with relevant context). We do not sell your content. See the Privacy Policy for details.
The Service, including its design, text, meditations, audio, software, and branding, is owned by Wellevate or its licensors and is protected by law. We grant you a personal, non-transferable, non-exclusive license to use the Service for your own wellbeing. You may not copy, resell, or redistribute our content without permission.
Wellevate relies on trusted third parties for hosting, sign-in, AI replies, and store payments. Your use of the Service may also be subject to those providers' terms.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free, or that Sol's replies will be accurate or appropriate for you.
To the fullest extent permitted by law, Wellevate and its team will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.
You can stop using the Service and delete your account at any time from Settings. We may suspend or end access if you violate these Terms or use the Service in a way that could harm others or us. Sections that by their nature should survive will continue to apply.
We may update these Terms. When we make material changes, we will update the date above and, where appropriate, mention it in the app. Continued use after an update means you accept the revised Terms.
To the fullest extent permitted by law, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration. You and Wellevate each waive any right to a class action, class arbitration, or representative proceeding. Either of us may still bring an individual claim in small-claims court if it qualifies. This does not take away consumer-protection rights that the law of your country of residence says you cannot waive.
These Terms are governed by the laws of the United States and the state in which Wellevate operates, without regard to conflict-of-laws rules. Nothing here removes any consumer-protection rights you have under the mandatory laws of your country of residence.
